Terms & Conditions

Applies to: the OKTAN mobile app, oktanhq.com, and all related services (together, OKTAN).

1. Agreement

OKTAN is operated by OKTAN HQ, registered at [REGISTERED ADDRESS] ("we", "us"). "OKTAN" means the service described above.

By creating an account or using OKTAN you agree to these Terms and to our Privacy Policy. If you do not agree, do not use OKTAN.

2. Eligibility and your account

• You must be at least 16 years old and legally able to enter a contract.
• You must give accurate registration details and keep your password secure.
• You are responsible for everything done through your account. Tell us immediately at security@oktanhq.com if you suspect unauthorised access.
• One account per person. Do not share, sell or transfer your account.

3. What OKTAN is — and what it is not

OKTAN is a record-keeping and information tool for vehicle owners. It helps you log services, fuel and modifications, track maintenance intervals, store documents, and ask Usta questions about your car.

OKTAN is not:

• a mechanic, garage, workshop, or licensed automotive professional;
• a source of professional, safety, legal, insurance, or financial advice;
• a diagnostic system, an inspection, or a substitute for one;
• proof of ownership, roadworthiness, service history, or vehicle condition;
• a warranty, guarantee or certification of your vehicle by anyone.

You are solely responsible for your vehicle. Always follow your manufacturer's handbook and have work done by a qualified professional. Never rely on OKTAN for anything affecting safety. If OKTAN and your manufacturer or mechanic disagree, follow your manufacturer or mechanic.

4. Usta

Usta is OKTAN's assistant. It generates responses automatically from the information available to it.

• Usta can be wrong. Its answers are informational only and may be inaccurate, incomplete or unsuitable for your vehicle. Verify anything important with a qualified professional before acting on it.
• Usta does not inspect your car, cannot see it, and does not know anything you have not recorded.
• Usta's answers are not advice, a diagnosis, a quote, a recommendation of any product or garage, or an instruction.
• Usage is subject to allowances (a limit on requests per day and per month) that differ by plan. We may change allowances, and may rate-limit, suspend or withdraw Usta features at any time.
• Do not use Usta for emergencies, medical or safety-critical situations, or to make decisions about anyone else's vehicle.

You accept all risk arising from any decision you make based on Usta.

5. Your content and your records

You keep ownership of what you put into OKTAN — your logs, notes, photos, receipts, documents and vehicle details ("Your Content").

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, process and display Your Content only to operate, secure, support and improve OKTAN for you. This licence ends when you delete the content or your account, except for backups and legal-retention copies described in the Privacy Policy.

You confirm that you have the right to upload Your Content, and that it does not infringe anyone's rights or break any law.

Accuracy is yours. OKTAN records what you enter. We do not verify it. Confidence tiers, the OKTAN Score, maintenance predictions, cost figures, fuel-economy calculations and exported PDFs are derived from your own entries and are estimates for your personal use. They are not audited, certified or guaranteed, and must not be presented to a buyer, insurer, court, regulator or anyone else as verified fact.

6. Free and Pro plans

• OKTAN offers a Free plan and a paid Pro subscription. Which features are Free and which need Pro may change.
• Subscriptions are sold and billed through the Apple App Store or Google Play, under their terms. We never see your payment card.
• Subscriptions renew automatically until cancelled. Cancel at least 24 hours before the period ends, in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google, under their policies. We cannot issue refunds for store purchases.
• We may change prices, plans and what each plan includes. Price changes take effect at your next renewal and, where required by law, only after notice and your consent.
• If your subscription ends, Pro features stop. Your data is not deleted — but content held above Free-plan limits may become read-only until you upgrade or reduce it.

7. Referrals

Referral links and codes are for personal use. Any reward is discretionary, has no cash value, and may be changed or withdrawn. We may cancel rewards and suspend accounts for self-referral, fake accounts, spam or any manipulation of the referral system.

8. Acceptable use

Do not:

• break any law, or use OKTAN for anything unlawful, fraudulent or harmful;
• upload content that is illegal, infringing, abusive, or that contains someone else's personal data without their permission;
• attempt to manipulate Usta's behaviour, extract its instructions, or use OKTAN to build or train a competing product or model;
• scrape, crawl, bulk-download or resell OKTAN's data, including the vehicle catalog and vehicle imagery;
• reverse-engineer, decompile, or interfere with OKTAN's security, rate limits, allowances or paid gating;
• probe, load-test or attack our systems, or use bots or automated access without our written permission;
• impersonate anyone, or misrepresent your connection to a vehicle you do not own or lawfully use.

We may investigate suspected breaches and cooperate with law enforcement.

9. Third-party services and data

OKTAN uses third-party services and data sources — including app distribution and billing, cloud hosting, error monitoring, mapping and location data, and model providers behind Usta.

Vehicle catalog data, maintenance intervals, fuel-station names, place names and vehicle images come from third-party and public sources. They may be incomplete, outdated or wrong. We provide them "as is" and are not responsible for them. Your use of a third-party service is governed by that provider's own terms.

10. Intellectual property

OKTAN, Usta, the OKTAN Score, our names, logos, design system, software, content and vehicle imagery are owned by us or our licensors and protected by law. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the OKTAN app on a device you own or control, for your own non-commercial use. All rights not expressly granted are reserved.

Do not copy, modify, distribute, sell, licence, or create derivative works from any part of OKTAN.

If you send us feedback or suggestions, we may use them freely without obligation to you.

11. Availability and changes

OKTAN is provided on an "as available" basis. We may add, change, suspend or remove any feature at any time, and may impose or vary limits. We aim to give notice of material changes but are not obliged to. We do not guarantee uninterrupted or error-free service, and we are not liable for downtime, data-sync delays, missed reminders or notifications that do not arrive.

Some features may be labelled beta, preview or early access. Those are provided without any warranty and may be changed or removed without notice.

12. Suspension and termination

You may stop using OKTAN and delete your account at any time.

We may suspend or terminate your account, immediately and without refund, if you breach these Terms, if we reasonably suspect fraud, abuse or a security risk, if required by law, or if we discontinue OKTAN. Where reasonable and lawful, we will give notice and a chance to export your data.

Sections 3, 4, 5, 9, 10, 13, 14, 15 and 17 survive termination.

13. Disclaimer of warranties

To the maximum extent permitted by law, OKTAN is provided "as is" and "as available", without warranty of any kind — express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that OKTAN will meet your needs, be uninterrupted, secure or error-free, or that any output — including anything from Usta, any score, estimate, interval, reminder or calculation — is accurate, complete, current or suitable for your vehicle.

Some jurisdictions do not allow the exclusion of certain warranties. Where that applies, the exclusions above apply only to the extent permitted, and nothing in these Terms limits rights you have as a consumer that cannot lawfully be limited.

14. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, data, goodwill or opportunity, however caused.
• We are not liable for vehicle damage, mechanical failure, injury, death, cost, fine, penalty, failed inspection, voided warranty, insurance dispute, missed maintenance, or loss on sale arising from your use of — or reliance on — OKTAN, Usta, any reminder, any score or any estimate.
• Our total aggregate liability for all claims relating to OKTAN is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 50.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

15. Indemnity

You will indemnify and hold harmless OKTAN, its officers, employees and contractors from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of OKTAN, Your Content, or your violation of any law or third-party right.

16. Changes to these Terms

We may update these Terms. We will post the updated version with a new "Last updated" date and, for material changes, give reasonable notice in the app or by email. Continuing to use OKTAN after the change takes effect means you accept it. If you do not accept, stop using OKTAN and delete your account.

17. Governing law and disputes

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules. Disputes will be resolved exclusively by the competent courts of Cairo, Egypt, unless mandatory law in your country of residence gives you the right to bring proceedings elsewhere.

Before starting formal proceedings, please contact us at legal@oktanhq.com — most issues can be resolved quickly.

Claims must be brought individually, not as a class or representative action, to the extent permitted by law.

18. App Store and Google Play

These Terms are between you and OKTAN only — not Apple or Google.

• Apple and Google are not responsible for OKTAN, its content, maintenance, support, or any claim relating to it.
• Your licence to use the iOS app is limited to Apple-branded devices you own or control, under Apple's Usage Rules in the App Store Terms of Service.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
• OKTAN — not Apple or Google — is responsible for product liability claims, claims that the app fails to meet a legal requirement, and claims that the app infringes intellectual property rights.
• You confirm you are not located in a country subject to an applicable embargo, and are not on any prohibited or restricted party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. General

• If any provision is held unenforceable, the rest remains in force.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
• These Terms and the Privacy Policy are the entire agreement between us about OKTAN.
• These Terms are drafted in English. Any translation is for convenience; the English version prevails.
